2023 EnduroCross Media Credential Information

Media access is available to national television and radio networks, local television and radio stations, recognized daily newspapers, news services, and racing publications, as well as other publications and internet sites that regularly cover motorsports and the sport of EnduroCross.

Eligibility: Applications must be submitted at least 14 days prior to the first event needed. Any applications received after this period will not be acknowledged.

Requests must include an assignment letter from an editor or publisher on behalf of the assigned reporter. Credentials will be issued to authorized personnel only for the purpose or providing timely coverage of the event.Freelance reporters, photographers and videographers must be on assignment from an accredited media outlet/publication. The included assignment letter must declare this. Pure freelance assignments are not permitted.

Marketing and advertising representatives from approved publications, teams and sponsors will be credentialed only if on editorial assignment. Approval of these requests will be at the sole discretion of Cycle City Promotions (EnduroCross).

Appropriate Attire: Media are required to dress appropriately. Shirts and shoes must be worn at all times; sandals are prohibited. Inappropriately dressed media may be required to remedy the situation or face credential revocation.

Event Rules: Media members must observe all event guidelines and regulations. If unsure, please seek information from the Media Manager or on-site security personnel. Do not begin work as a media member unless you understand the event rules and regulations.

Photographs: All photos taken are the property of Cycle City Promotions (EnduroCross). Websites may upload still images from any event; however, these images may not be used for any commercial or retail purposes without the express written consent of Cycle City Promotions (EnduroCross) and the athlete(s) depicted. Cycle City Promotions (EnduroCross) reserves the right to request the removal of any unapproved photos from publication.

Video:  Video recording of any kind is prohibited without prior written approval from Cycle City Promotions (EnduroCross). Upon approval, video access is permitted both in the paddock and on the racetrack. All recorded footage is the property of Cycle City Promotions (EnduroCross). Any media taking video without approval will forfeit their credential, and the footage will be confiscated. Cycle City Promotions (EnduroCross)reserves the right to request the removal of any unapproved videos from publication.

Only approved Photographers and Videographers are permitted track and infield access. No other Media are permitted track access.

Media track access is limited to those areas where Media can safely capture images without endangering either themselves or event competitors. Accordingly, Media are prohibited from standing in or on the edge of the race track or  “otherwise interfering with the race” and must maintain a safe distance from the designated edge of the track surface at all times.

Media may not stand in front of or otherwise block any TV camera or sponsor signage. Media are expected at all times to conduct themselves in a safe and professional manner and may not impede in any way the activities of race officials, track workers or TV camera operators.

Media are prohibited from crossing the race course during active competition (including practice) other than at designated media crossing areas. In the unlikely event it is imperative to cross an active or “hot” race track, media are expected to do so only in areas that provide adequate opportunity to safely cross the circuit without impeding the on-track activity and only when safe to do so. Media will be provided with a Media Track Access Map, indicating the locations of the designated approved media track crossing areas, during each Media Safety Meeting on Saturday morning.

Media credentials is granted at the sole discretion of Cycle City Promotions (EnduroCross) and may be revoked at any time without notice.

This Photo License Agreement (this “Agreement”) is made as of this 01 day of September, 2023 (the “Effective Date”) by and between Media Credential Requestor (“Photographer”) and EnduroCross, LLC. (“EnduroCross”). The parties agree as follows:
1. License. Photographer hereby grants to EnduroCross an exclusive, perpetual license to use the following work (the “Photos”):
(A). AMA EnduroCross Championship Series - Any and all photos taken at any AMA EnduroCross Championship Series event.
2. Ownership of Photos. Photographer agrees that EnduroCross is the owner of all right, title, and interest, throughout the world, to all Photos and any copies of the Photos. EnduroCross reserves all rights and licenses not expressly granted in this Agreement.
3. Restrictions on Use. Photographer will not use the Photos for any of the following purposes:
(A). No Unlawful Use. Photographer will not use the Photos in any unlawful manner, such as pornography or defamation.
(B). No Standalone File Use. Photographer will not use the Photos in any way that allows a standalone file or content file to be downloaded, extracted, or redistributed by others.
(C). No Use in Trademark or Logo. Photographer will not use the Photos in any trademark, design, logo or other mark.
(D). No Products for Resale. Photographer will not use the Photos in any goods or products where the Photos are the primary value.
4. Photo Notice and Markings. EnduroCross does not need to include a photo credit or copyright notice on the Photos.
5. Limitations of Liability. EXCEPT FOR ANY REMEDIES THAT CANNOT BE EXCLUDED OR LIMITED BY LAW, NEITHER PARTY, NOR ANY AFFILIATE, WILL BE LIABLE UNDER THIS AGREEMENT TO THE OTHER PARTY, ANY AFFILIATE OR OTHER THIRD PERSON FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, RELIANCE, OR PUNITIVE DAMAGES OR LOST OR IMPUTED PROFITS, LOST DATA OR COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES.THIS LIMITATION OF LIABILITY MAY NOT BE VALID IN SOME STATES. ENDUROCROSS MAY HAVE RIGHTS THAT CANNOT BE WAIVED UNDER CONSUMER PROTECTION AND OTHER LAWS. PHOTOGRAPHER DOES NOT SEEK TO LIMIT ENDUROCROSS’S WARRANTY OR REMEDIES TO ANY EXTENT NOT PERMITTED BY LAW.
6. Termination. Either party may terminate this Agreement immediately upon delivery of written notice to the other party specifying clearly the grounds for termination if the other party commits a material breach of its obligations under this Agreement and fails to cure the breach within 30 days after written notice of the breach is received by the breaching party. For the avoidance of doubt, termination will be without prejudice to any liability incurred prior to the effective date of termination.
7. Assignment. This Agreement may not be assigned by Photographer without EnduroCross’s prior written consent. EnduroCross may assign this Agreement, in whole or in part, to any affiliate or successor.
8. Severability. If any provision of this Agreement is held invalid, illegal or unenforceable by a court of competent jurisdiction, the remainder of the Agreement will be valid and enforceable and the parties will negotiate in good faith a substitute, valid and enforceable provision which most nearly puts into effect the intent of the parties.
9. No Waiver. This Agreement may not be altered, modified, or amended in any way except in writing signed by both parties. The failure of a party to enforce any provision of the Agreement will not be construed to be a waiver of the right of such party to thereafter enforce that provision or any other provision or right.
10. Entire Agreement. This Agreement represents and constitutes the entire agreement between the parties, and supersede and merge all prior negotiations, agreements, and understandings, oral or written, with respect to any and all matters between the parties.
11. Governing Law. The parties hereby agree that this Agreement will be governed by, and constructed and enforced in accordance with the laws of the State of Oklahoma, without reference to rules governing choice of laws.
12. Disputes. Any dispute arising from this Agreement shall be resolved through mediation. If the dispute cannot be resolved through mediation, then the dispute will be resolved through binding arbitration conducted in accordance with the rules of the American Arbitration Association.
13. Attorneys’ Fees. If either party brings legal action to enforce its rights under this Agreement, the prevailing party will be entitled to recover from the other party its expenses (including reasonable attorneys’ fees and costs) incurred in connection with the action an any appeal.
14. Notices. All notices, demands or other communications to be given under this Agreement by either Party to the other may be effected either by personal delivery in writing or by U.S. mail, registered or certified, postage prepaid with return receipt requested. Notices delivered personally will be deemed communicated as of actual receipt. Mailed notices will be deemed communicated as of two (2) days after mailing.

IN WITNESS WHEREOF, the Parties have entered into this Agreement as of the Effective Date.
